The HC bench of Justices S S Shinde and N J Jamadar on November 16 held: "Statutory provisions, which limit the period of police custody, would be rendered illusory if the accused is detained in police custody in spite of a reasoned and conscious order passed by the magistrate declining police custody and remanding the accused to judicial custody. Such infraction, in our view, warrants award of compensation."
